1. Definitions

• "Services" means the bills payment services provided through the App.
• "User" means you, the individual using the App.

2. Eligibility

To use the App, you must:

• Be at least 18 years old.
• Have a valid email address and phone number.
• Have a valid bank account or payment method.

3. Account Registration

To use the Services, you must register for an account ("Account") by providing accurate and complete information. You are responsible for maintaining the confidentiality of your Account login credentials.

4. Payment Terms

• The App allows you to pay bills using various payment methods.
• You authorize the App to charge your designated payment method for the amount of the bill payment.
• You are responsible for ensuring that your payment method has sufficient funds to cover the bill payment.

5. Bill Payment Processing

• The App will process bill payments in accordance with the instructions provided by you.
• The App will not be responsible for any errors or delays in processing bill payments caused by factors beyond its control.

6. Payment Gateway Terms

• By using the Payment Gateway, you agree to be bound by the terms and conditions of the Payment Gateway.
• The Payment Gateway's terms and conditions are incorporated into these Terms by reference.

7. Fees

• The App may charge fees for certain Services, which may be disclosed to you before you use the Service.
• You agree to pay all fees and charges incurred in connection with your use of the Services.

8. Intellectual Property

• The App and its content, including all intellectual property rights, are owned by billsmart.ng.
• You may not reproduce, distribute, or display any content from the App without the prior written consent of billsmart.ng.

9. Disclaimer of Warranties

• The App and Services are provided on an "as is" and "as available" basis.
• billsmart.ng disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

• In no event shall billsmart.ng be liable for any damages, including incidental, consequential, or punitive damages, arising out of your use of the App or Services.
• billsmart.ng's liability for damages shall be limited to the amount of fees paid by you to billsmart.ng in the preceding 12 months.

11. Indemnification

You agree to indemnify and hold harmless billsmart.ng and its affiliates, officers, directors, employees, and agents from any claims, losses, damages, or expenses arising out of your use of the App or Services.

12. Termination

• billsmart.ng may terminate or suspend your use of the App or Services at any time, without notice, for any reason.
• Upon termination, you must immediately stop using the App and Services.

13. Governing Law

• These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
• Any disputes arising out of these Terms shall be resolved through binding arbitration in accordance with the rules of the Lagos Court of Arbitration.

14. Changes to Terms

• billsmart.ng may modify these Terms at any time, without notice.
• Your continued use of the App or Services after the effective date of any modifications shall constitute your acceptance of the modified Terms.
